PLANNING AND ZONING

PERMITTING & CODE ENFORCEMENT

With the exception of minor repairs--a permit is needed to upgrade, modify, or install any fixed or movable improvements or structures to real property or to alter the land. This is to verify compliance with the Building Codes of the Town as well as New York State. The application process typically requires a minimum of five (5) business days to process.

Section 192-106 *Owners of non-residential facilities with two or more tenant spaces are required to obtain Town of DeWitt Planning Board approval prior to the issuance of a sign permit.*

Swimming Pool (Install ANY type of swimming pool with a sidewall height of 24” or higher)

Do Not Need a Permit:

Making ordinary repairs (i.e. installing or repairing gutters and downspouts; installing or replacing siding; replacing windows or doors of equal size; installing or removing internal NON-load bearing partition or walls; installing or replacing a roof providing no more than 2 layers are to be covered; replacing bathroom or kitchen appliances, carpet, cabinetry; painting, sheetrock)

 

 

Proof of Workers Compensation 
 
ACORD forms are NOT acceptable proof of NYS workers’ compensation. Under Worker’s Compensation Law (WCL), Section 57, businesses requesting permits, licenses or seeking to enter contracts must provide ONE of the forms listed below.
 
Acceptable Forms:                 
-Insured (C-105.2 or U-26.3), Certificate of Workers’ Compensation Insurance OR State Insurance Fund’s version of the C-105.2 form 
-Self-insured (SI-12) Certificate of Workers’ Compensation Self-Insurance (the Board's Self- Insurance Office: 518-402-0247)
-Exempt (CE-200) (If there are NO employees) Certificate of Attestation of Exemption From New York State Workers’ Compensation and/or Disability Benefits Insurance Coverage 
-Owner-Occupied Residence (BP-1) (if homeowner is performing the work)

 

Signs

Principals guiding sign review and permitting:

1. Signs should be simple in design and generally rectilinear in shape. The identification of the business or organization shall be the sole message.

2. The size, placement, color, style, and height of signs shall be selected to effectively convey the identification message.

3. Sign location should be chosen to provide ready visibility while avoiding visual clutter and obstruction.


Commercial Real Estate Signs (CRES)

CRESign rules are intended to simplify and control real estate sale or lease signs. Generally, a parcel for sale or lease may have one (1) CRESign which may be detached or attached to a building wall.

 

Nonconforming Signs
May NOT be modified or repaired unless the entire sign is brought into conformance with the sign code.
